AwaHop Rider Terms of Service

1. Who provides the service
These Terms govern the use of AwaHop by customers requesting or taking passenger rides.
AwaHop is operated by Awa Technology Services Ltd., House 4, 1 E Road, Phase 2, F.H.A., Lugbe, Abuja, Federal Capital Territory, Nigeria.

AwaHop is a technology platform connecting riders with independent drivers. It does not itself provide transportation services. The responsibilities of the parties remain subject to applicable Nigerian law and relevant transport requirements.
2. Accounts and eligibility
Account holders must be at least 18 years old, provide accurate registration information and keep their account credentials secure.
An adult arranging a lawful ride involving a minor must have appropriate authority and ensure the minor is suitably supervised.
AwaHop does not offer a dedicated unaccompanied-minor service.
3. Booking and fares
The app calculates an estimated fare using routed distance, time, ride category and any applicable zone or demand pricing, and displays the fare before booking confirmation.
The final fare may reflect the trip actually performed, subject to the disclosed pricing rules.
Before a booked trip starts, the rider must give the driver the four-digit trip PIN; the trip cannot start until the PIN is verified.
4. Cancellations and no-shows
Customers may cancel a ride through the application.
An applicable free-cancellation period and any cancellation charge will be communicated through the application. Where a charge applies, its amount will be disclosed before the customer confirms a chargeable cancellation.
A rider is not charged a cancellation fee when the driver cancels or AwaHop cannot find a driver.
Applicable cancellation charges remain subject to Nigerian consumer-protection laws and any legally required exemptions.

5. Payments and refunds
You authorise the payment of applicable ride fares and any valid, disclosed charges through the payment methods supported by AwaHop.
Refunds and billing disputes are handled in accordance with the AwaHop Cancellation and Refund Policy.
6. Conduct, safety, restriction and closure
The AwaHop Safety & Community Standards form part of these Terms.
Serious breaches may result in temporary restriction while a report is assessed or termination where justified.
You may request account deletion through the app's Legal & Privacy area or the public account-deletion route.
Records may be retained where a continuing lawful basis applies, including financial duties or open safety and dispute matters, as described in the Privacy Policy.
7. Liability and consumer rights
AwaHop will provide its platform services with reasonable care and in accordance with applicable Nigerian law.
Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded, including statutory consumer rights and liability arising from fraud, negligence or AwaHop's own legally actionable acts or omissions.
Drivers are independent contractors, not AwaHop employees or agents for employment-law purposes.
Subject to applicable law, AwaHop is not responsible for circumstances beyond its reasonable control, including independent third-party conduct, payment or telecommunications disruption, road and traffic conditions or government restrictions.
This provision does not excuse AwaHop's own liability where applicable law imposes it.
To the extent allowed by Nigerian law, you agree to indemnify AwaHop and its officers, employees and affiliates against reasonable claims, losses and expenses arising from your breach of these Terms, misuse of the service, or violation of law or third-party rights.
This does not waive non-excludable consumer protections.
8. Disputes and governing law
These Terms are governed by Nigerian law.
Parties will first attempt to resolve a dispute amicably.
If unresolved within 30 days, the dispute may be referred to arbitration in the Federal Capital Territory, Abuja, under the Arbitration and Mediation Act 2023 with one arbitrator appointed in accordance with that Act, subject to non-excludable rights and remedies under applicable law.
Nigerian courts have supervisory jurisdiction over the arbitration.
9. Changes
Where material changes require renewed acceptance, you may be asked to read and accept an updated policy before the next ride.
Support, safety, privacy and account functions should remain accessible in the meantime.
